OUR TERMS AND CONDITIONS

This agreement sets out the terms and conditions that will govern the relationship between us, Carney Academy (CA Ltd) and you, the Parent/Guardian/Adult Student. It is a legally binding agreement. These conditions are important to maintain standards and to ensure that all members gain the maximum benefit from their membership.

  • Any free trial (taster session) is strictly at the approval of the Academy Principal, subject to availability and does not guarantee a place at CA Ltd. A free trial may not be claimed in retrospect.

  • Membership of CA Ltd entitles you to send one child/yourself, to one of the CA Ltd Academies, it is possible to move from one Academy to another should the need arise. Any additional student, from the same family group requires an additional membership (discretionary sibling/family discount offered where applicable - all available discounts and conditions can found later in our terms and conditions).

  • Fees are totalled annually (inc. VAT), and subject to change depending on the number of teaching weeks per academic year. Payment of fees is divided across 11 teaching months. VAT invoices are available on request. Discounted fees will vary (details on application).

  • The minimum membership period is one term. You must pay the monthly membership subscription by Direct Debit for the minimum membership period unless your membership is terminated without liability, suspended or transferred in accordance with these terms. The Academy reserves the right to change the day, time and location of the sessions. Should this be restrictive to attendance the minimum notice period will be waived.

  • In the event that your child/you is unable to attend a scheduled CA Ltd session, due to sickness (subject to the clause below), holiday, government restrictions or a decision by the Parent or Student not to attend, CA Ltd is unable to offer any refund of fees paid, or make up the missed session.

  • We will suspend membership during the minimum membership period in the event that the child/you is unable to attend the Academy for more than one month due to injury or illness. In the unfortunate event that it is medically no longer possible to attend any CA Ltd we will cancel the minimum membership period without any further obligation to you. We may require suitable medical evidence in the form of a GP or hospital letter setting out the medical reasons.

  • In the event that you do not make the membership fee payments when due, the right to attend any  CA Ltd Academy will be withdrawn until payment is received and brought up to date. Interest is payable (whether before or after judgement) on any sums not paid when due at the rate of 4% p.a. above the base lending rate of RBS Bank calculated daily. If your account falls into arrears on more than three occasions during any one calendar year we reserve the right to terminate your membership with immediate effect.

  • At the end of the minimum membership period (one academic term), your membership will automatically continue unless either party cancels by giving the other at least 14 day's notice. If you do not intend to continue with the next term, you must inform the school no later than 14 days before the end of the current term. Cancellation outside of this policy will incur a cancellation fee totalling one weeks tuition, collected by direct debit upon termination of membership.

  • A 14 day notice period is required for termination of membership and can only be given in writing via email to info@carneyacademy.co.uk. The time of receipt (not sending) shall be the time of commencement of the notice period.

  • We may terminate your membership and discontinue your entitlement to attend the Academy in the event of serious or repeated breach of these Membership rules.

  • Payment is due no later than the last Friday of each calendar month. Payment must be made by Direct Debit mandate. If payment of membership fees is not made in full for any reason we reserve the right to suspend your membership.

  • Current discounts available are: 10% reduction off full membership price for Single Parent Households, adult students in full time university education (proof or student status required) & households in receipt of Universal Credit (suitable evidence required in the form of copies of the 3 most recent Universal Credit statements or entitlement letters. If you have been on Universal Credit less than 3 months please provide copies of the all the statements or entitlement letters you have received so far. Your statements are obtained by you from your online Universal Credit account. If you don't have an online Universal Credit account, to request copies of your entitlement letters please contact the Department for Work and Pensions or your Jobcentre Plus office). 20% reduction off full price membership for for second applicant/sibling from same household. Discounts cannot be combined, used in conjunction with one another or claimed in retrospect. CA Ltd reserves the right to amend or withdraw available discounts at anytime.

  • CA Ltd has a student referral scheme, open to current members only, details laid out as follows: Should a current CA Ltd member refer a new student, who then signs up for a membership, the current member will receive a 50% reduction off the next available term. Discount not applicable to current term. If the current student cancels membership at end of current term, the 50% reduction will be unredeemable. 50% reduction cannot be claimed in retrospect or transferred to another student. Students attending on one of our discounted memberships, who refer a student, who then signs up for a membership, will receive a 50% reduction off the full price of the next available term and not the discounted price. Maximum 2 referral discounts, per current student, per academic year. CA Ltd reserves the right to amend or withdraw current referral scheme at anytime.

  • Class timetables and teachers are subject to change from time to time without notice. 

  • We reserve the right to revert to online sessions for any enforced closure outside of our control. This includes, but not limited to, national and localised shutdown due to weather, pandemic, venue availability and lockdown. Where an Academy is running physical face-to-face sessions, or a combination of physical face to face sessions and online sessions, the standard monthly fee applies and is payable via direct debit. Where an Academy is running exclusively online for a period of 12 or more consecutive weeks a reduced fee will then apply. Details on request.

  • Performance is a group activity and students are signed up on the understanding that they will attend all lessons. Full attendance means everyone can benefit wholly, from the session. When someone is missing unexpectedly, it is detrimental to the whole group. Where attendance rates do dip below 80% without forewarning or good reason, we reserve the right to ask a student to leave CA Ltd.

  • Known student absence, for instance planned holidays, weddings, birthday celebrations etc should be reported at the start of each term. No discount/refund can be offered for missed classes in these circumstance, but our teachers can plan around an expected non-attendance.

  • In order to avoid disturbing classes, students are requested to arrive in good time. Entrance to classes may be barred to anyone arriving more than 15 minutes late, without good reason or forewarning. Late arrivals to teaching sessions must be reported in good time.

  • A teacher may, at any time, ask a student to leave a class if their presence is jeopardising the safety or enjoyment of others or their educational experience.

  • Each Academy may also have its own additional rules of which you will be notified. All students, parents/guardians, teachers, volunteers and any other guests are required to observe these rules in full.

  • We reserve the right to use any individual or group photographs of students for press or promotional purposes, unless you have opted out, at point of sign up (please see taster booking form for relevant waiver). If at any point during your membership to CA Ltd, you wish to opt out of our photography policy, please do so in writing, to our contact email address.

  • Film and Television performance is one of the core modules at CA Ltd. Students may, from time to time, be filmed on camera in teams, or individually. This footage may be shared on our official channels, at friends and family screenings and sometimes even entered into film festivals. By registering with CA Ltd, you are agreeing to these terms of membership, unless you have opted out, at point of sign up (please see taster booking form for relevant waiver). If at any point during your membership to CA Ltd, you wish to opt out of our photography policy, please do so in writing, to our contact email address.

  • Bullying, harassment, abuse or other inappropriate behaviour by any student or persons associated with any student is strictly forbidden and will result in expulsion and such other legal remedies as may be available.

  • To the extent permitted by law, our liability to you, save in respect of death or personal injury caused by our negligence shall be limited to the total amount you have paid for your membership.

  • All student or persons associated with any student must treat all CA Ltd members, staff and volunteers with respect and consideration. CA Ltd does not tolerate rude, offensive or aggressive remarks and behaviour in any way.

  • All student or persons associated with any student, staff and volunteers must make themselves aware of the health and safety policy, and rules of the each individual teaching venue and comply with the recommendations at all times.

  • Smoking/vaping and the bringing or consumption of alcohol and the use or being under the influence of illegal substances is not permitted anywhere in our Academies.

  • If you have a complaint or concern that cannot be resolved via the Academy Principal please contact our managing director (contact details available on request).

  • We reserve the right to make changes to these rules.

  • This agreement is governed by the laws of England and Wales.
